The rules for using the Open HR platform

1. Acceptance of Terms
These Terms of Service govern your use of the Open HR platform. By creating an account or using our services, you agree to these terms in full.
If you do not accept these terms, please do not use our services. We recommend reading this document carefully before signing up.
Open HR reserves the right to modify these terms. Any material changes will be notified to you by email at least 30 days before they take effect.
2. Service Description
Open HR provides employment infrastructure enabling workers to collect, verify, and share their professional references in a portable way.
Our services include: collecting references from your former employers and colleagues, identity verification, secure storage of your data, and controlled sharing with potential employers.
Your references belong to you. You decide when and with whom to share them. We facilitate this sharing but never make employment decisions on your behalf.
3. User Accounts
To use Open HR, you must create an account with a valid email address. You must be at least 18 years old or the legal age of majority in your country of residence.
You are responsible for keeping your login credentials confidential and for all activities under your account. In case of unauthorised use, notify us immediately.
You agree to provide accurate information and keep it up to date. Open HR reserves the right to suspend accounts containing manifestly false information.
4. Subscriptions & Payments
Pricing
All displayed prices include applicable VAT. The exact amount depends on your country of residence and will be calculated at checkout.
Automatic Renewal
Your subscription renews automatically at the end of each period (monthly or annual) unless you cancel before the renewal date. You will receive a reminder email 7 days before each renewal.
Cancellation
✓ You can cancel your subscription at any time from your account dashboard.
Cancellation takes effect at the end of the current period. No cancellation fees apply. You don't need to contact us — everything is done online.
14-Day Withdrawal Right
In accordance with consumer law, you have 14 days to withdraw after subscribing, without reason and without fees. This right can be exercised by contacting us or through your account dashboard.
If you started using the service during this period with your explicit consent, you may need to pay an amount proportional to the services used.
Refunds
Outside the withdrawal right, subscriptions are not refundable pro-rata. After cancellation, you retain access until the end of the paid period.
5. User Conduct
When using Open HR, you agree to:
- Provide accurate and truthful information
- Not impersonate others
- Not attempt to bypass security measures
- Not use the service for illegal purposes
- Respect the confidentiality of your referees' information
Any violation of these commitments may result in suspension or closure of your account, without prejudice to our right to seek damages.
6. Intellectual Property
Your personal and professional data belongs to you. You grant us only a limited licence to use it in connection with our services.
The Open HR platform, including its code, design, and the ((○)) mark, are our exclusive property or that of our licensors. You may not copy, modify, or distribute them without authorisation.
You retain all rights to the content you submit (references, documents). We use it only to provide the service.
7. Limitation of Liability
Open HR is committed to providing the service with diligence but does not guarantee uninterrupted or error-free operation.
Our liability is limited to the amount you paid us in the last 12 months, except in cases of gross negligence or wilful misconduct on our part.
We are not liable for hiring decisions made based on platform information. Employers remain solely responsible for their decisions.
These limitations do not apply to rights you have under the law, particularly as a consumer.
8. Termination
You can close your account at any time from your dashboard. After closure, you can request deletion of your data in accordance with GDPR.
We may suspend or close your account for violation of these terms, after warning you and giving you the opportunity to respond, except in cases of serious violation requiring immediate action.
In case of account closure, you retain the right to export your data for 30 days after closure.
9. Governing Law & Disputes
Governing Law
These terms are governed by French law, without prejudice to mandatory provisions of your country of residence that would be more favourable to you.
Amicable Resolution
In case of dispute, we invite you to first contact us at contact@open-hr.fr to try to resolve the issue amicably.
Mediation
As a consumer, you can use consumer mediation free of charge. Contact details for the relevant mediator will be provided upon request.
Competent Courts
Failing amicable resolution, the courts of Paris shall have jurisdiction for professional users. Consumers may bring claims before the courts of their place of residence.
